Follow My Lead Dog Training Contract

This Agreement between ___________________ (hereinafter referred to as “Client”) and Follow My Lead (hereinafter known as “Trainer”) pertains to the following: Client’s Dog (Name): ______________Breed: ____________ Age: _ Color:___ (hereinafter referred to as “Dog”)

For good and valuable consideration, the parties agree as follows:
Private Lesson or Group Services:

Training Fees:
The Client agrees to pay the Trainer a nonrefundable fee in the amount of $________ for a package of _ session/s (approximate length ____ each) to be paid at first session. All sessions must be completed within 90 days from the date of commencement of contract or they will be forfeited. However, if the Client decides to cancel the program, they have up until the start of the second lesson. Be aware the Client will receive a refund minus $199 to cover the cost of the first lesson (additional travel fee may be applicable). This contract remains in full effect for any repurchases or continuing clients even after completion of initial package or lesson purchase.

Travel Fees: Travel fee will apply to any lesson not done at the Trainer’s location. No discount applies (unless otherwise noted). For those who wish to meet at the Trainer’s location, the fee is waived.

Returned/Bounced Checks: If a Client’s check is returned for any reason, the Client is responsible for any and all fees incurred to Follow My Lead due to this error. A $35.00 returned check fee, and the face value of the check to be paid in cash within 14 days after notification by the bank to Follow My Lead.

Private Lessons: The Trainer agrees to provide private lessons for the Client and Dog on a lesson-by-lesson basis, the goal being to teach the Client how to train and work with the Dog. These lessons will take place at the Client’s home or other agreed upon location. The Trainer will make every reasonable effort to help the Client achieve training and behavior modification goals but makes no guarantee of Dog’s performance or behavior as a result of providing professional animal behavior consultation. The Client understands that he/she and members of the household must follow the Trainer’s instructions without modification, work with the Dog daily as recommended, and constantly reinforce training being given to the Dog.

Cancellation Policy: If the Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due. For a package deal, the session will still be counted as one session.

Responsibility and Liability: If the Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to the Trainer and the Trainer’s agents), during or after the term of this Agreement, then the Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the Trainer and the Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including
attorney fees. If the Dog is injured in a fight or in any other manner during or after the term of the Agreement, the Client assumes the risk and agrees that the Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

Follow My Lead, Jennifer Chavez/Liz McLaughlin will endeavor to create as safe an environment as possible for the training of the Dog and will offer only sound, safe, and responsible training and training instructions. However, the Client recognizes that Follow My Lead, Jennifer Chavez/Liz McLaughlin is not responsible for any unintentional errors, omissions, or incorrect assertions. The Client understands that the recommendation of any other product or service is not a guarantee of satisfaction with that product or service. Further, the Client is and will remain responsible for the actions of the Dog at all times and the Client hereby agrees to indemnify and hold harmless Follow My Lead, Jennifer Chavez/Liz McLaughlin of any and all claims of injury, expense, costs, or damages caused by the actions of the Dog while under Follow My Lead, Jennifer Chavez/Liz McLaughlin instruction or control and under the Client’s care as a result of following training instructions. The Client has been told by Follow My Lead, Jennifer Chavez/Liz McLaughlin and understands the inherent risks of owning a dog, including but not limited to the risk of dog bites to the Client or others. At the Trainer’s sole election, the Trainer’s duties hereunder shall terminate if (a) in the Trainer’s sole judgment the Dog is dangerous or vicious to the Trainer or any other person or animal, or interferes with the training of other dogs, or (b) the Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, the Trainer’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

This Agreement is binding upon the Client, spouse/partner of the Client, and children of the Client and/or representative of the Client as well as Follow My Lead and its representatives/trainers. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between the Client and the Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the Dog or anything else. Without limiting the generality of the foregoing, the Client acknowledges that the Trainer has not represented, promised, guaranteed or warranted that the Dog will never bite, that the Dog will not be dangerous or vicious in the future, that the Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both the Client and the Trainer. The Client acknowledges and agrees that they are solely responsible for the Dog and the Dog’s actions during training classes and in the future. The Client acknowledges and agrees that any training the Dog and the Client receives or contract for does not constitute any guarantee whatsoever that the Dog will not cause harm or loss, intentional or unintentional, to a human being, animal or property. The Client hereby holds Follow My Lead, Jennifer Chavez/Liz McLaughlin harmless of any liability for my dog or any of my dog’s actions including, but not limited to, intentional or unintentional actions that cause harm or loss to a human being, animal, or property, during the training period, or at any time in the future.

The Client hereby holds Follow My Lead, Jennifer Chavez/Liz McLaughlin harmless of any liability for any loss or damage to me, my dog or my property including, but not limited to, loss or damage from disease, other dogs, other persons, other pets, my dog running away, fire, or other unavoidable causes.

Photo/Video Release: The Client releases any photos or videos taken during lessons or sent to Follow My Lead for public use. Please be aware Lesson Dates may change, be pushed out a week, for example (but not limited to) in the instance the Trainer is ill. We thank you in advance for your flexibility and understanding in your schedule. We try to avoid changes of Lesson Start Dates, but occasionally it may occur. Students who have signed up and paid are notified via e-mail their Individual Class Confirmations & Details of the change. The Client is responsible to check e-mail before each Lesson. Please allow flexibility in your schedule; there are no refunds for date adjustments. It is extremely rare for a Lesson to be canceled.
